User Agreement
This User Agreement forms the terms and conditions for the use of services and products of Wild Trail Adventures (WTA).
Any person (User) who inquires about or purchases any service provided by WTA through its website, salespersons, offices, or other sales channels agrees to be governed by this User Agreement. “User” refers to travellers/customers/guests.
These terms & conditions apply to the various services offered by WTA. The User should refer to the relevant Terms of Service applicable for the Service booked by the User. The applicable Terms of Service for the respective Service shall be binding on the User.
Eligibility
- Users must be at least 18 years old and legally capable of entering into a binding agreement under applicable laws.
- Minors (under 18) are prohibited from using the WTA website or engaging in transactions directly.
- If a minor wishes to use or transact on the website, a legally authorized representative (such as a parent or guardian) must act on their behalf.
- Access to and use of the website must comply with the applicable laws of the user's jurisdiction.
- WTA reserves the right to terminate membership or block access if an individual is found to be a minor or legally incompetent.
- Users must read and understand the User Agreement before using the website, sales channels, or services.
- By proceeding, users acknowledge and agree to be bound by the terms and conditions of the User Agreement.
- If a user disagrees with any part of the User Agreement, they must refrain from using WTA’s website, services, or sales channels.
- All rights, obligations, and liabilities between the user and WTA are governed strictly by the User Agreement.
Liability
- By making a booking, the User understands that WTA acts only as a travel agent/service provider for booking package tours, safari services, and related products.
- WTA’s liability is limited to providing the User with a confirmed package booking as selected by the User and as per agreed itineraries.
- If a booking cannot be confirmed due to unforeseen reasons, WTA’s obligation is limited to refunding the booking amount and any other payments received from the User.
- Such a refund shall fully discharge WTA from all liabilities related to that transaction.
User Responsibility
- The User acknowledges that the use of the Website or Services is undertaken at the User’s sole risk.
- Users are strongly advised to review the description of the Services carefully before making any booking.
- By proceeding with a booking, the User agrees to be bound by the terms and conditions set forth in the booking confirmation or the confirmed booking voucher.
- These terms must be read in conjunction with this User Agreement, the Terms of Service, and the regulations of the respective Service Providers as provided on the Website.
- If a User makes a booking on behalf of a third party, they confirm they are legally authorized to do so.
- The User is responsible for ensuring that third parties are informed of the terms and conditions, including all applicable rules and restrictions.
- The User agrees to adhere to all procedures, guidelines, and policies established by WTA regarding the use of its Services, as updated from time to time.
- The User undertakes to comply with all applicable laws, regulations, and orders issued by statutory, regulatory, or judicial authorities concerning the use of the Services or any related transactions.
- The User shall not use or permit third parties to use the Website or the Services for any purposes other than those explicitly outlined in this User Agreement.
- Disclosing or reselling login credentials to unauthorized parties.
- Utilizing the Website or Services for unauthorized commercial purposes.
- Making speculative, false, or fraudulent bookings.
- Accessing, monitoring, or copying any content or information on the Website using automated systems (e.g., robots, spiders, or scrapers) or manual processes without prior written permission from WTA.
- Taking actions that could damage, disable, impair, alter, circumvent, or overload WTA’s infrastructure.
- Attempting to obtain information through unauthorized means.
- Reproducing, distributing, or reselling any content, software, or Services from the Website for commercial or competitive purposes.
- Framing, mirroring, or incorporating any part of the Website into another channel or website without express written authorization.
- Uploading, providing, or sharing materials that infringe upon third-party intellectual property rights or other legal rights.
- Impersonating another person or misrepresenting their affiliation to deceive or defraud others.
- Sending unsolicited emails or spam to third parties.
- Uploading viruses, malware, or malicious code to WTA’s systems.
- Engaging in any actions that could harm the Website, WTA, or its reputation.
- Using the Services in a manner that violates any applicable laws, including infringing the rights of third parties or uploading content that infringes intellectual property rights.
Website
- The material provided on the Website may include technical inaccuracies or typographical errors due to inadvertent human errors and judgment.
- WTA reserves the right to make changes or improvements to the Website at any time.
- Services are offered on an “as is” and “as available” basis.
- WTA may modify the features or functionality of the Services at its sole discretion without prior notice to the User.
- To the fullest extent permissible under applicable law, WTA disclaims all warranties, express or implied, including but not limited to:
- Warranties of accuracy.
- Uninterrupted access.
- Non-infringement.
- Merchantability.
- Fitness for a particular purpose.
- No advice or information obtained by the User, whether oral or written, shall create any warranty not expressly stated herein or in the Terms of Service.
- The User acknowledges that uninterrupted access to the Website may be affected by factors beyond WTA’s reasonable control, including but not limited to:
- Internet or telecommunications failures.
- Maintenance activities.
- Service interruptions.
- WTA shall not be liable for any loss or damage arising from such issues.
- The User consents to being contacted by WTA representatives via telephone, SMS, or email.
Payments
- The User shall bear full responsibility for all charges, fees, duties, taxes, and assessments arising from the use of the Services, in accordance with applicable laws and regulations.
- In addition to the cost of booking as determined by the Service Providers, WTA reserves the right to impose fees, including but not limited to:
- Convenience fees
- Service fees
- WTA further retains the right to modify such fees at its sole discretion.
- Any additional fees, including those for modifications, shall be communicated to the User prior to booking confirmation or payment collection.
- In the event of a shortfall in the booking amount, taxes, statutory fees, or convenience fees due to technical errors or other reasons:
- WTA reserves the right to recover the balance amount from the User.
- The User agrees to remit such amounts upon request.
- If the shortfall is identified before the utilization of the booking, WTA reserves the right to cancel the booking if the outstanding amount is not settled before the utilization date.
- Any increase in the price charged by WTA resulting from:
- Changes in tax rates
- Imposition of new taxes or levies by governmental authorities
- In the rare event of a booking not being confirmed for any reason:
- WTA will process a refund of the booking amount paid by the User and notify them accordingly.
- WTA shall not be obligated to provide alternative bookings, compensation, or replacements for unconfirmed bookings.
- Any subsequent bookings shall be treated as separate transactions.
- Refunds, if applicable, will be processed in accordance with the policies of the Service Provider and WTA.
- The User agrees to make payments solely to the official bank accounts of WTA.
- WTA, its agents, representatives, or employees will never request the User to transfer funds to private accounts or accounts not held in the name of WTA.
- WTA shall not be held liable for any loss incurred by the User as a result of transferring funds to unauthorized or personal accounts.
- The User shall have no claim against WTA for recovery of funds transferred to third parties.
- The User agrees not to share sensitive personal information, including:
- Credit or debit card numbers
- CVV codes
- OTPs
- Card expiry dates
- User IDs or passwords
- The User shall immediately inform WTA if such information is solicited by any individual claiming to represent WTA.
- WTA shall not be held liable for any loss suffered by the User due to sharing such information.
- Refunds for canceled or missing bookings will be processed exclusively to the bank account from which payment was originally made.
- WTA shall not be liable for any circumstances resulting in:
- The User missing a flight
- A no-show
- Unutilized bookings
- Refunds, if applicable in such cases, shall be subject to the policies of the relevant Service Provider and will be processed only after WTA receives the refunded amount from the Service Provider.
- The User is advised to request refunds for no-shows or unutilized bookings within:
- 180 days of the missed check-in date
- Or within a shorter period if specified by the Service Provider
- Any claims for refunds made beyond this period shall be deemed forfeited.
Cancellation and Refunds
- All cancellation requests must be notified in writing by the user making the booking.
- The request must be sent from the registered email ID and phone number associated with the user.
- The percentage of cancellation charges shall be mentioned in the trip proposal.
- The customer shall be bound by the enlisted “cancellation policy” of the Company.
- The cancellation policy is mutually agreed upon in writing at the time of the proposal.
- In addition to the cancellation charges agreed in the tour proposal:
- The user will also need to bear bank charges/transaction costs as per actuals.
- These charges will be informed to the user.
No refunds will be made by the company in case of following situations
- In the event of flight cancellations or rescheduling affecting the agreed program:
- No cancellation refunds shall be provided by the company.
- The company may, at its discretion, attempt to arrange alternatives.
- Any rescheduling charges shall be borne by the customer.
- The company shall not be liable for cancellation refunds if the trip cannot proceed due to safety hazards arising from Acts of God, including but not limited to:
- Tsunamis
- Earthquakes
- Pandemics
- Volcanic eruptions
- The company shall not be liable for cancellation refunds if the trip is disrupted by man-made hazards such as:
- Sabotage
- Accidents
- Riots
- Supply shortages
- Strikes
- Lockouts
- Civil unrest
- Curfews
- In cases of a no-show by the customer:
- No refunds shall be provided.
- Exceptions, if any, will be governed by the cancellation policy specified in the tour proposal.
Others
Travel Documents
Users need to review their itinerary and other travel documents for accuracy and inform WTA promptly of any issues.
The names submitted to the WTA tour manager at the time of booking should match government-issued IDs.
Many countries require a passport to be valid for six months or more after the date of entry.
Some countries will not admit persons convicted of a crime.
Some countries require both parents’ consent for minors to travel.
Travel Insurance
Obtaining sufficient insurance coverage is the obligation of the User.
In no case shall WTA be responsible for any claims arising out of unforeseen scenarios.
Visa
All VISA requirements are to be obtained by the User as per the requirements of their travel bookings and the regulations of the countries they intend to visit or transit through.
These include tourist visas, transit visas, amongst others.
Vaccinations
It will be the responsibility of the User to get all necessary vaccinations for their travel.
Warranties
WTA will make all efforts to ensure safety during tours but shall not be liable for any deaths, injuries, or accidents that happen to any of the users on our tours.
Disputes
Governing Law & Dispute Resolution
This User Agreement shall be governed by the laws of India. Any disputes arising in connection with these Terms shall be resolved through binding arbitration to ensure an expedient and cost-effective resolution. Arbitration shall be conducted in New Delhi, India. The arbitrator will be appointed mutually or by a competent court if no agreement is reached.
By agreeing to these Terms, both parties waive the right to a jury trial or participation in a class action.
The arbitration proceedings shall be conducted in English, and the award shall be final and binding on both parties.
The initiating party shall bear the entire cost of arbitration.
All disputes and claims must be made within 30 days of the trip’s end.
